§ 3-33. Duty of the chief of police; tax and license coordinator.

  • (a)

    Within 45 days of filing of any citation, accusation, warrant, or any other disciplinary action in the Municipal Court of Hinesville that alleges a violation of this chapter by a licensee or an employee, agent or representative of a licensee, the Chief of Police shall forward copies of the citation, accusation, warrant, or any other disciplinary action to the Tax and License Coordinator, and to the Special Agent in Charge of the Savannah Regional Office of the Alcohol and Tobacco Division of the Georgia Department of Revenue as required by O.C.G.A. § 3-3-2.1. The term "disciplinary action" as used in this paragraph means any citation or arrest arising out of the violation of any law, rule, regulation, resolution, or ordinance of a governmental entity relating to the manufacture, distribution, sale, or possession of alcoholic beverages against a licensee, an employee of a licensee, or any person holding a financial interest in the license of the licensee on the premises or place of business of any licensee.

    (b)

    Within 45 days of the conviction of a licensee or an employee, agent or representative of a licensee, of any provision of this chapter or O.C.G.A. § 3-3-23(1)(a), prohibiting the furnishing of alcoholic beverages to underage persons, the Chief of Police shall forward certified copies of the conviction to the Special Agent in Charge of the Savannah Regional Office of the Alcohol and Tobacco Division of the Georgia Department of Revenue as required by O.C.G.A. § 3-3-2.1. The term "conviction" as used in this paragraph shall include a finding or verdict of guilt, plea of guilty, or a plea of nolo contendere.

    (c)

    Upon receipt of copies of any accusation, citation, warrant, or any other disciplinary action from the Chief of Police alleging a violation of this chapter by a licensee, or an employee, agent or representative of a licensee the Tax and License Coordinator shall notify the Mayor and the City Manager.
